Wheel came off on motorway, are garage liable??

It happens.. I left Stealth with a pair of loose track rods one time, got 12 miles away before I figured out what the rattling was. Couldn't believe it would be something significant but ultimately checked before I got on the M40.. and thank fff I did..!
