vornwend 0 Posted October 13, 2010 Oh damn so sorry to read this Paul. Hope you can get it fixed and more importantly that you don't suffer any long term damage to your health. I was rear ended a couple of years ago and I can still remember the gut wrenching feeling when I walked around the back to see the damage for the first time. I couldn't think of anything else but getting it fixed for weeks. It is absolutely amazing what body shops can do so fingers crossed you'll be able to salvage it. Since I only too well can still remember when I was rear-ended more than 6 years ago in my beloved Mk1 Rocco (could still today kill the bloke who did that :mad2: !). Fortunately I had a witness 2 cars behind me, as we were all leaving a show. Fortunately also the police were approaching on the opposite lane, who immedtaiely took statements from all parties involved and pics. I decided to claim from my own insurance straight away, as I had just renewed, so by the time the renewal was up again, they would have reclaimed the cost from the opponent´s insurance. It all went rather quiickly, I have to admit, got my Mk1 repaired to my exacting standards within 4 weeks. That was. however, thanks to serious hassling of the insurers: Daily emails, faxes, recorded deliveried letters, telephone calls, and rejecting the assessor´s initial verdict (calling him a w*nker, when he said something like the very expensive custom-made rear Rieger skirt was nothing more than a Mondeo plastic bumper!! That just proved to me that this assessor didn´t have a frigging clue about modded cars, which is what my insurance company claimed to specialise in!). Anyway, don´t give up fighting! Tedious but only way to get anything done quickly. Then I read about your neck etc stiffening up. Alarm bells time!!! Paul, serious, get yourself to a doctor tomorrow, A&E actually. When I was rear-ended, friends of mine immediately upon arrival back home (me in tears looking at my wounded Mk1 Rocco of course, so can wholly feel for you), took me to my local A&E to get my neck and back checked over, next morning to my GP, followed by a visit to my local police station, where I described the accident both material and body harm aspects. Then keep track of how much time off work you may have to spend, costs for envelopes, telephone calls etc. any extra costs due to this accident, that you would otherwise would not have had to incurr. Claim everything back! That stupid c*w should not have hit you, in case you feel bad about doing all this. 2 months after my Rocco was repaired my insurers came back to me saying I had mentioned at the time that I had a sore neck (which did get worse after 1 night sleep, morning after at GP it did ache quite badly, and my rear-ender was at much lower speed than yours!), had not been able to carry out sports for 3 months, so off to their appointed doc they sent me for an assessment. Result: Extra 3k from the opponent´s insurance to stick in a savings account, in case you may ever need it (still a small amount if in the future you may for whatever reason due to this accident not be able to carry out your proefession and lose your financial livelihood). 4eyes2wheels 0 Posted October 13, 2010 Sorry to hear this - watch the neck and back injuries - got rearended on the M25 a rfew years ago and adrenalin took me through the the next morning and then my god it hurt. If this driver has injured you then you deserve to claim for the personal injuries and the damage to the Nugget. I hope the agreed value and insurance system does what is right by you. Take care. Just under 2 years ago when it was all icy on the roads, I crashed my mk2 gti into a telegraph pole. Literally 20 mins later I was stood chatting to a couple of blokes in their workvan about what had happened, when a car came sliding down the same bit of ice. She managed to turn to avoid the telegraph pole but in doing so, came straight at the side of the van and me! All I could do was jump into the air and be scooped up onto the bonnet, cracking her windscreen with my shoulder. She then slammed on her brakes when the ice was finished, sending me flying off the car and skidding down the road on my arse!!! Somehow I just got up and dusted myself off, and to this day I don't know how but I opened her door and asked if she was ok :cuckoo: She was in hesterics thinking she had killed me or something. I laughed afterwards about asking if she was alright. All this happened in the morning, I felt a bump and knock obviously but was mobile. Everyone was telling me to go to the hospital but I felt fine. As the evening wore on, I stiffened up terribly and just about got myself to the A&E. Nothing broken but bashed up proper good! Stupid female on her mobile phone failed to notice the red traffic light and the fact that five cars were all stopped. Probably fortunate the car was worth more at that time as it was repaired under insurance. I however, being a manly bloke said I'm alright and I'm off on leave anyway so everythings OK. Was it Feck. It was almost a week before I went to the doctor and the girls insurance used that succsesfully to limit what was a legitimate claim due to my "manliness". I almost wept when I saw the pictures on page 1 of the post as it looked so familiar though mine had front end damage as well as I got pushed into the car in front. Look on the bright side. You're still breathing and, if the worst comes to the worst, it may be possible to buy it back and get it repaired yourself. If anyone else has said this, sorry for repeating it. I just read the first few posts and it all felt so familiar. Get a bottle of Wolfblass Yellow label as an aspirin subsitute and wait for the good lady to get home to console you. People will avoid hitting it at all costs!! And of all of the stereotypes who'd do it, a woman in a 4x4. I rest my case. How the f'ck can you not see a bright yellow car in front of you? :roll: Is it definitely a write off? :( I'd be surprised if it isn't. Look how buckled the rear 1/4 is :? I had a look around it when I came up to stay and went to Harewood House and thought it was a stunner :( Utterly gutted for you mate. Take one consolation from this though.. at least it wasn't the VR. Yes, the Nugget was immaculate but you'd not already sunk thousands of hours into it unlike the VR! Try and be philosophical to get it into perspective. Hope you recover from your physical injuries soon. Apart from your injury, exactly the same thing happened to me in Polo saloon, when "Nicole" in high heels and very short skirt crushed the back of "papa's" car with her Clio. Dippy b!nt! I mentioned the "totally inappropriate footwear for driving" in my insurance claim. Ain't we men such despicable hypocrites! As the guys have said is possible, the bodywork guys worked a miracle - you could not tell the car had been bent at all. If your yellow peril is a write off, think of the fun and opportunity you can have looking for that replacement! Be sure to choose a safer colour next time - grey or summat. Best outcome as some have said is that the car is repairable and the dozy woman's insurers pay out a few grand in a personal injury claim. Definitely go to the doctors, ask when you should return if the pain continues because my GP originally flogged me off with "Stretch it and take some painkillers and ibuprofen". When I was rear ended in my G60 I suffered neck and back pain from November to mid - Feburary. . When going to a chiropractor about reoccurring issues with my back in January he did some work on my neck also which really helped. A year on though and my neck is still causing me grief and I think it always will. My Personal injury claim is still ongoing. :s Hopefully your car can be repaired. Although he has an agreed valuation policy with his own insurance company, the damage is the fault of a third party. They will try every trick in the book to avoid settling on the agreed valuation terms of Paul's insurance. In fact I'd almost guarantee it. They will initially just offer him a lowball figure from Parker's guide, and when it's pointed out as agreed valuation, they will argue the toss over the valuation, the condition, demand thier own valuation (which of course will differ dramatically), continue to lowball, and on and on and on and try and wear him down. Kip will probably need to be very patient, and will need his own insurer to really fight his corner. It would actually be simpler if Kip had totalled the car himself (where contractual liability is with thier own client) And watch the TP insurer dispute the injury compensation as well... Kip, if it gets difficult you should mention the TP insurer that thier Client is clearly guilty of driving without due car and attention, and was also lucky that she ploughed into the car of your car instead of mowing down a family with children instead. That kind of argument is a powerful and valid one, if you think they are just mucking you about. In fact did the Police attend the incident? It might be worth a complaint to the Feds for a change of DWDC considering your car was bloody bright yellow and yet she didn't manage to see you. Worth a thought mate... worth a thought...
